Dearly‐loved Friends,

One of the spiritual responsibilities of the followers of Baha’ullah is to observe the Huququ’llah (the Rights of God), a law requiring the payment of 19% of the surplus from the annual income of a Baha’i’s work, trade, or crop.

The Blessed Beauty has acknowledged the payment of Huququ’llah in the Kitab‐i Aqdas, as a means of increasing blessings and bounty, and to cause kindness in different respects.
The USNSA, with the assistance of the trustees of the Rights of God, will be holding 4 meetings on January 31st to Feb 1st 2015, on the East coast of the United States. This is in order to encourage the Friends to pay the Huquq’ullah, and to plan for its receipt.

They also intend to encourage those among the youth who are employed and possess particular skills to pay the Huququ’llah.
We should all observe the following issues regarding the very important status of the Huququ’llah.

1. According to Kitab‐i Aqdas, payment of the right of God is a private and personal affair. No one is permitted to ask for it. No one is allowed to insist upon its payment. Therefore, to hold meetings, public invitations for the Friends, and any such planning for the receiving of the Huququ’llah from the Friends, etc.; all such activities that the USNSA is engaging in, is not in compliance with the Baha’i Revelations.

2. Bahaullah, in His tablet, Lisan‐e‐Huzur (The Language of Presence) has prohibited the attempt to own, collect, or partially/wholly consume the Huququ’llah, without the permission of the authority of the Cause.

Abdul‐Baha, in his Will and Testament, has clearly specified that “only the Guardian is the right authority of the Cause, and the Guardians will be the sole lawful recipients of the Huququ’llah.”
Moreover, in the “Nazar‐i Ejmali Bar dianat‐e‐Bahai” (an Introduction to the Bahai Faith, written By Ahmad Yazdani), the contents of which were approved and confirmed by the beloved Guardian, we read the following:

Payment of the Huququ’llah is a religious obligation; but none are authorized to ask for its payment. It will be collected by the trustee of the Huququ’llah, and will be submitted to the Guardian of each period, that sanctified reference and authority of the Baha’i Cause.And it will be utilized according to his decision.

The Universal House of Justice, despite its position in the Baha’i Faith is not allowed to receive the Huququ’llah. Only Shoghi Effendi during his own lifetime, and the Guardians who followed thereafter are authorized to receive and consume the Huququ’llah (Right of God).

3. The UHJ, during its more than 50 years of activity, has not provided any annual or periodic bill, for the large and frequent amounts received as donations, compensation, Huququ’llah, properties of the heirless deceased, etc., from Baha’is worldwide.
This lack of transparency in the financial affairs of the UHJ will lead to severe mistrust. It will also lead to accusations of the misappropriation of funds, accusations like the following: that such large amounts were used for expanding the already overly‐bureaucratic Baha’I administration, for payments to the Elective branch of the Baha’I administration, for the salaries of the 150 staff members of USNSA, or other unnecessary expenses, rather than towards public welfare, charity, or promotion of the word of God.

I sincerely invite the beloved Baha’i Friends to investigate the authorized persons and institutions for receipt of the Right of God
(Huququ’llah), before committing to any such payment.

Dear Mr. Shahram ,

Your letter of Jan 29, 2015 and its commendable attached document, was recently forwarded to me. The writer (Sahba Vejdani) has exposed the wrong doing of the so called Universal House of Justice (UHJ) regarding the demanding and collecting the Right of God (Huququ’llah), without having any authority to do so and in contradiction to the provisions of the sacred Will and Testament of 'Abdu’l-Bahá.

Sahba has justifiably requested Bahá’is to: “investigate the authorized persons and institutions for receipt of the Right of God (Huququ’llah)” 

The Will and Testament of Master, 'Abdu’l-Bahá, undeniably establishes the fact that the Guardian of the Cause of God is the Center of the Cause and regarding the Right of God (Huququ’llah), clearly reveals that:

“It is to be offered through the Guardian of the Cause of God”

Shoghi Effendi, the first Guardian of the Cause of God, has emphasized that:

“According to the Master's Will, which complements the Aqdas, the Huquq goes only to the Guardian." -  (To Mr. George O. Latimer, Portland, Oregon, dated Haifa, June 17, 1933. Extracts from the USBN)

Nosrat’u’llah Bahremand is the Guardian of the Cause of God, the Center of the Cause, and as did the Guardian before him, considers that presently it is not obligatory for the Bahá’is to pay Huququ’llah.

To the contrary:

The illegitimate UHJ, which has no such authority to demand Huququ’llah, is doing just that.   In fact, even a legitimate Universal House of Justice, which in the future and in due time, will be established in accordance to the provisions of the Will and Testament of 'Abdu’l-Bahá, cannot claim such authority.

It is important to note that the so called UHJ was spuriously created by the former Hands of the Cause, without authority and in total contradiction to the provisions of the Will and Testament of 'Abdu’l-Bahá, in which it is clearly ordained that the Guardian of the Cause of God is “its sacred head and the distinguished member for life of that body. Should he not attend in person its deliberations, he must appoint one to represent him. Should any of the members commit a sin, injurious to the common weal, the Guardian of the Cause of God hath at his own discretion the right to expel him, whereupon the people must elect another one in his stead.” - (The Will and Testament of 'Abdu’l-Bahá)

The Tablet of Lisan‐e‐Huzur, revealed by 'Abdu’l-Bahá, in response to the questions of a person (Wahid Lisan‐e‐Huzur), can be found in the Ma'idih-yi-Asmani, V2 p75.  This Tablet contains a total of 646 words, in response to different questions asked by Wahid Lisan-e-Huzur, of which only 13 words are included in the specific answer by 'Abdu’l-Bahá relating to one unknown question. It is this answer, which was selectively picked up by the bogus UHJ in 1972, that was used as justification for their actions regarding Huquq, which states:

 “Disposition of the Huquq, wholly or partly, is permissible, but this should be done by permission of the authority in the Cause”

Then in their translation from the original text to English, the illegitimate UHJ, in their own words, added:  “to whom all must turn” and then claimed that: “In another Tablet 'Abdu'l-Bahá referred to the Universal House of Justice as "the authority to whom all must turn"

Subsequent to this notice and their bogus claim of authority to demand Huququ’llah  in 1972, the illegitimate UHJ has yet to this day been able to reveal the claimed tablet of ‘Abdu’l-Bahá to the Bahá’i World or provide any substantiating reference as to its origin.  This is obviously because no such table exist, as it would be in contradiction to what ‘Abdul’-Bahá had made very clear in his Will and Testament, that:

 "the authority to whom all must turn" is none other than Guardian of the Cause of God.
“The mighty stronghold shall remain impregnable and safe through obedience to him who is the Guardian of the Cause of God. It is incumbent upon the members of the House of Justice, upon all the Aghsán, the Afnán, the Hands of the Cause of God to show their obedience, submissiveness and subordination unto the Guardian of the Cause of God, to turn unto him and be lowly before him. He that opposeth him hath opposed the True One, will make a breach in the Cause of God, will subvert His Word and will become a manifestation of the Center of Sedition.”   - (The Will and Testament of 'Abdu’l-Bahá)

Coincidently, in the same Tablet of Lisan‐e‐Huzur, 'Abdu’l-Bahá explains that:

“Aghsan (Branches) are not limited and restricted to certain people, they have perpetual motion, whoever will be steadfast will be accepted and whoever be wavering will fall”

I hope that this response provides you with some clarity as to the question regarding the authority of the illegitimate UHJ in demanding and collecting the Right of God (Huququ’llah).  I would also encourage you to visit the website of the Guardian of the Cause of God, Nosrat'u'llah Bahreman @ http://www.bahai-guardian.com, where you will find many in-depth and scholarly writings that address the question of the twin institutions of the Guardianship and the Universal House of Justice and their sacred relationship, as established by 'Abdu'l-Bahá in His Will and Testament.

Bahá’ís neither seek nor accept funds from others for activities that relate to the internal development of the Bahá’í community. The Bahais cannot and do not ask for Huququllah as per the guidances of Abdul Baha.


But !! Funds from private, national, or international agencies are "sometimes" received for social and humanitarian initiatives.????


The Bahai meetings, often simple, have a variety of elements to accommodate (i.e. brainwash) participants regardless of their religious background. Music, food, and discussion (brainwashing) are often present, though the primary purpose is to use prayer’s power to TRANSFORM, unify, and revitalize. (Especially transform into becoming Bahais.)


At the heart of the Revelation of Bahá'u'lláh is the FORCE OF TRANSFORMATION, both of the individual and of society .


Thus, Bahá'ís are actively engaged in developing knowledge (of terrorism), skills (at getting lots of money), and spiritual insights (brainwashing) that enable them to act as effective human resources and which are vital to the integrated process of personal and social TRANSFORMATION.


Thus Bahais believe that by learning about our spiritual reality and our individual role in the PROGRESS OF SOCIETY , we can better understand our purpose in life and the way to improve our own lives ($$$$) and the lives of those around us (slaves.)


So the ANSWER is :
Money for Bahá’í activities and projects comes from the taxpayers and fools.

The following is the Canadian funds report as submitted to the Canadian Revenue Agency by the NSA of Canada. Thanks to this government mandated disclosure, Baha’is get a glimpse into the financial workings of their community. Sadly, this is something that would not be possible otherwise since the NSA believes that opacity takes precedence over transparency and have not to this date shared such information with the community at large voluntarily or supplemented the government mandated disclosure with any further information or explanations.
As with last year’s exercise, this one leaves much to be desired. It isn’t difficult to find errors and strange things in the T3010 forms. I encourage you to go to the source and see for yourself at the CRA website.
RevenuesJust as last year, the total revenue reported by the NSA (or whoever filled out the T3010 on behalf of the NSA) is incorrect. The total revenue line is quite simple to calculate, if you know how to add and read at a rudimentary level.
As the form helpfully says: "Total revenue (add line 4500, 4510 to 4580, and 4600 to 4650)". If we do so, following that guidance diligently, the amount is $13,539,028. However, the amount reported by the NSA is $14,980,518.
A significant discrepancy of $1,441,490.



Simple arithmetic 2, Treasury Department of the NSA 0. The brutal battle royale continues. Perhaps we should buy the NSA a calculator? or an abacus at least. That should even the odds a bit.
What could possibly explain the $1.4 million discrepancy? I don’t really know but it may have something to do with the $2 million interest and investment income.
I suspect that this amount is also incorrect and that it has lead to the incorrect total revenue amount being reported. By itself it seems beyond belief for three simple and logical reasons. First, we are in a low interest rate environment. Second, I don’t believe that the NSA would jeopardize the funds of the Faith by exposing them to high risk, and therefore, seeking a high return. Third, the total portfolio amount reported is not large enough to provide for such a yield.
Finally, if we are to argue that the $2 million in interest and income derived from investments is a reasonable amount, then we must explain how the NSA’s portfolio did not earn an amount even approaching that sum the previous year.
Last year the NSA reported just $83,700 for the line 4580 "Total interest and investment income received or earned". So obviously something is amiss.
It would make sense if the $2 million were to be instead disposition of assets. Or a combination of interest and income earned as well as disposition of assets.
Apart from such odd discrepancies, the pattern of donations seems to be holding steady from last year and increasing from prior years.
Assets and LiabilitiesThe assets of the Baha’i community of Canada have been steadily increasing over the years. In 1996 the liquid assets (excluding capital assets like buildings) were a little over $5 million. In 2010 they were more than $32.5 million.




There was an uncharacteristic decrease in 2004 but once again, I suspect that this is due to an error. Prior to 2004 the NSA had been reporting $12-13 million in "Other Investments" but in 2004 they suddenly reported zero and continued to do so until 2009 when they suddenly reported $4.35 million.
The other interesting thing is that the NSA is reporting $5.2 million in liabilities in 2010. This is the most debt the NSA has reported for more than 15 years. It is probably a mortgage debt related to one or more properties.
I hope that with this warchest, the NSA doesn’t resort to the past manufactured financial crisis situations to motivate Baha’is to donate. Cash or cash equivalents are at $27 million, receivables at more than $1 million and investments at $4.35 million. This year there was a surplus of $2.8 million.
The key question is what is the NSA planning to do with this much money? As the amount grows, so does my concern. This large amount of money coupled with limited or non-existent controls, oversight and disclosure provides for a fertile environment for nasty things to happen. We’ve already seen a financial scandal in Italy. I don’t want to see one in Canada.
As the total amount grows, so does the potential for theft and fraud. As does the challenge of managing the money and providing proper stewardship. Unfortunately, we have no information about who is managing this portfolio for the NSA nor how they are doing so.
Commensurate with the large amounts in question is the imperative for the NSA to give proper account of what exactly its intentions are for the funds and how they are managing them.

There is a great importance of Huququllah in the Bahai Faith.
Huququllah is an Arabic word comprised of two words. Huquq meaning “Right” and “Allah” meaning “God”. Therefore Huququllah means “Right of God”, a part of the individuals possession and income offered at the Threshold of God.
Huququllah being the Right of God and bounty for the people is clear from the Bahai Holy writings of sayings of The Bab, Bahaullah and Abdul Baha

O people of the world, whatever ye have offered up in the way of the one true God, ye shall indeed find preserved by God, The Preserver, and Intact at Gods Holy Gate.
Thus the embryo of the sacred law of Huququllah was established by the Bab in the Persian Bayan, His book of Laws.
Bahaullah brought some modifications in its content and fashioned it as one of the worlds shaping ordinances of His stupendous Revelation.


Writings of Bahaullah:

Bahaullah affirms “….the payment to the Right of God is conducive to prosperity, to blessing and to honour and divine protection”
"As to Huququllah, this is the source of blessing and the mainspring of God’s loving kindness and tender love vouchsafed unto men”.
In Kitab-i Aqdas verse 97, it has been revealed by Bahaullah:
Should anyone acquire one hundred mithqals of gold, nineteen mithqals thereof are Gods and to be rendered unto him, the fashioner of the earth and heaven. Take heed o people, lest you deprive yourselves of such a great bounty. This we have commanded you, though though we are well able to dispense with you and with all those who are in the heavens and on earth, in it there are benefits and wisdoms beyond the ken of anyone but God, The Omniscient, the All-informed Say, By this means He hath desired to purify what ye possess and to enable you to draw nigh unto such stations as none can comprehend save those whom God hath willed, He in truth is the Beneficent The Gracious, The Merciful .O people deal not faithlessly with the Right of God , Nor without His leave , make free with its disposal .Thus hath his commandments been established in the holy tablets and in this Exalted book .He who dealeth faithlessly with God shall in justice meet with faithlessness himself , He , however , who acteth in accordance with Gods bidding shall receive a blessing from the heaven of the bounty of His lord , the Gracious , the Bestower , the Generous , the Ancient of Days.He verily hath willed for you that which is yet beyond your knowledge , but shall be know to you when , after this fleeting life , your souls shall soar heaven wards and the trappings of your earthly joys are folded up.Thus admonished you He in Whose possession is the Guarded Tablet.

O friends of Abdul Baha The Lord as a sign of his infinite bounties hath graciously favoured His servants by providing for a fixed money offering (Huqooq) to be dutifully presented unto Him, through He m, the true One and His servants have been at all times independent of all created things, and God verily is the all-possessing, exalted above the need of any gift from His creatures. This fixed money offering however causeth people to become firm and steadfast and draweth Divine increase upon them

Abdul Baha commenting on the manifold powers latent in the Law of Huququllah writes"
“…In accordance with His inscrutable wisdom and in order to apply a unique test to distinguish the friend from the stranger, He hath enjoined the Huqooq upon His servants and made it obligatory.”
From all the above quotations it is amply clear that the source of energy for upholding the law of huqullah is the individuals love and loyalty to the covenant.
As Abdul Baha, Himself says that it distinguishes the friend from the stranger; this is nothing more or less than a test of ones firmness in the covenant.

The small Italian Baha’i community was shocked to learn that one of its most prominent, long-serving and active members, the former General Secretary of the NSA: Franco Ceccherini, had been ousted from the NSA and formally charged for embezzlement and fraud in the amount of 360,000 Euros.

Ceccherini allegedly stole the money over the lengthy period of time that he served at the highest levels of the Baha’i community in Italy. It appears that he embezzled funds from 1992 until 2006 by fraudulently producing invoices, letters and documents and then pocketing the funds he received for them. Throughout the more than 14 years that Ceccherini served in the institutions, he alternated between high level positions: sometimes he served as the General Secretary of the NSA of Italy, while other times he served as the Head of the Office of the Secretariat – which included several other individuals employed by the NSA. And at times Ceccherini served as both General Secretary and as Head of the Office of the Secretariat.

Through the uninterrupted access granted to him by these positions, Ceccherini was able to allegedly perpetrate this scheme for almost 15 years. It is still a mystery how the Treasurer could not detect such a large and prolonged fraud. Nor is it known what, if any, control measures were circumvented by Ceccherini. As it stands now, neither the Treasurer, any of the other NSA members nor any employees of the NSA have been charged.

The scheme began to unravelled when the Italian equivalent of the IRS contacted the NSA of Italy and filed a charge of tax evasion against it. Through the ensuing audit and investigations it came to light that all these years Ceccherini had been pocketing the funds that should have been going to the INPS and the INAIL (state pension and worker’s compensation/insurance plans).

My suspicion is that since most continental European Baha’i communities (France, Italy, Spain, Portugal, etc.) do not have the privilege of incorporation enjoyed elsewhere, the actual banking was in the name of an individual. And my guess is that individual was Ceccherini; because of his tenure within the Baha’i community or simply because he was trusted. After all, when you are unincorporated, you must trust an individual to administer the finances in their name. There is no other option. If my suspicions are correct it explains why the Treasurer or other person were not caught up in the fraud and how one person alone could perpetrate it.

Consequences of this tragedy are many. For one, the NSA of Italy has been thrown into total chaos. It has had to deal with an extensive internal investigation and financial audit. Theis is a serious financial blow to the community as funds which should have been paid to the government for more than a decade now need to be paid in lump sum. Thankfully the government has agreed that the NSA as an institution was not perpetrating the fraud and agreed to dismiss 90,000 Euros in interest and fines they had levied. Which means that the NSA has to pay back 275,000 Euros. The House of Justice has loaned the Italian NSA 200,000 Euros to buffer the blow to their annual budget. This loan will have to be repaid to the House in installments over time but the NSA will still have to make a lump sum payment of 75,000 Euros. A significant chunk of change for a community the size of Italy.

Other consequences are more intangible. The spouse of Ceccherini, also a prominent Baha’i was removed from her position as an Auxiliary Board Member (Propagation). The news has left the Italian community shell-shocked since Ceccherini was seen as a pillar of the community. On top of this, several projects such as the office of public information have had to be closed or curtailled sharply due to lack of funds.

No matter how extensively one creates control measures, nor how draconian in nature, they can be circumvented by another person. Ultimately, nothing short of personal transformation can prevent such criminal acts. As Baha’u'llah says in the Hidden Words:

“Busy not thyself with this world, for with fire We test the gold and with gold We test Our servants.”

But this does not mean that there aren’t lessons to be learned from such a sad state of affairs. Nor that common sense should not be used. What we have in the institutions of the Baha’i Faith basically relies on the good character of those within it. If they falter, then there are no measures to protect the community. This has to change.

We have no transparency, no control measures, no accountability and no term limits. Combine these and you have a potentially explosive situation. Add the spark of human shortcoming and you have a bomb that can devastate whole communities and lay waste to decades of painstaking growth and development.

TRANSPARENCY
The Baha’i community has gradients of financial transparency. At the local level, things are quite clear with regular reports by the local treasurer and detailed reports of budgets and expenses. At the national level, things get decidedly more murky. Less detail is divulged: only income and expenses are shared (not assets and liabilities) , while the delegates to the national convention are the only ones who get to see and look at the full accounts – but they can’t share them with their communities and they have a very tight schedule with limited time to look over them. At the international level, the picture gets pitch dark with absolutely no information divulged except for the estimates of large scale projects (recent examples are for the Arc and the Chile temple). Beyond that, trying to pry financial information at this level is like trying to shuck an oyster with jello.

Financial reporting is most detailed and most transparent at the local level, where ironically the least amount of money is involved. The Italian incident involving 360,000 Euros may seem like a lot of money but it is a rounding error in international budgets. This culture of opacity and secrecy is fertile ground for the nastier attributes of human nature and must be blotted out from the Baha’i community.

CONTROL MEASURES
If due to an inability to incorporate, the affairs of a whole community have to be placed in the hands of a person, a simple control measure is to open a shared or joint account. This way two people must be aware of and make authorization for any transactions. Second, I for one am still not convinced how the Italian national treasurer can not be atleast found to be culpable of gross negligence in this case. Pleading ignorance is no defense for them. If anything they should be fully investigated and asked to resign, if for nothing more than their incompetence in recognizing and preventing such a long lived scheme. Similarly simple and easy control measures are left unimplemented in Baha’i instititutions. Blame incompetence, ignorance or a childish innocence. Whatever the reason, it is plain stupid to not have them.

ACCOUNTABILITY
My fellow Baha’is usually bristle at that word since we believe that the institutions are not to be held accountable to their community. But this only extends to decisions. I’m speaking of management. An NSA should be held accountable to its community for mis-management, as this case clearly illustrates. If you are incompetent, you have to answer to the community. Period. The principle of non-accountability is not a free pass for negligence and idiocy.

TERM LIMITS
This is a much broader concept than I can do justice to here but put plainly it means that individuals have a limit to the number of years they serve in Baha’i institutions. In almost all Baha’i communities, large and small, we find that a small group of individuals dominate the elected and appointed institutions year in and year out. This has sadly become the norm. The consequence is that these individuals start to create little fiefdoms and get quite comfortable. Even getting a sense of entitlement. Can anyone doubt that Franco Ciccherini could have perpetrated such a massive (both in length and in quantity) fraud had we had term limits which limited his access to the highest levels of administration? There are many, many other benefits to term limits beyond the prevention of fraud and crime within the administration. I will explore this topic in more detail at a later time and hope to do justice to it.

It is my hope that the Baha’i community in Italy will learn from this tragedy, rebuild, move on and continue to grow. And that Baha’is elsewhere will use this opportunity to avoid similar painful learning experiences by beginning to consult on how to increase transparency and accountability with the institutions; how to implement common sense control measures and how term limits can benefit the community.

IN A complaint filed in a city court few months back, trustees of the National Spiritual Assembly of Bahais of India have been accused of espionage by their colleagues. Apparently, they were supplying classified documents to Israeli and Iranian spying agencies and making huge amounts in foregn currency.Pls see the detailed article which appeared in the local newspapers.

All this shows how the hard earned maney of the Bahai's is going down the drain.
Some strict action needs to be taken soon otherwise the huququllah collected and the various funds and donations received will definitely be over in no time .
All the trustees have definitely been great beneficiaries of this scam and they are trying to supress the story as far as possible. Their homes and bank lockers are full of cash and the poor Bahai's are suffering miserably in India.
All Bahais are being urged to give Huququllah and funds towrads various causes , but if this is what is happening then only GOD can save the community.
Huququllah is the " RIGHT OF GOD" and not the " RIGHT OF TRUSTEES" and whatever money they have embezzled they need to return back to the community and also step down from the esteemed position and office they are holding.
